Welcome, and thank you for choosing to work with Coach Brandi Kiana-Jo.

These Terms & Conditions (“Terms”) apply to coaching services, programs, memberships, communities, courses, workshops, events, digital products, and other services offered by Coach Brandi Kiana-Jo (“Coach Brandi,” “we,” “us,” or “our”).

By purchasing, enrolling in, or participating in a service, you agree to these Terms as well as any terms presented in your checkout, invoice, offer, or individual agreement.

Some programs, including private coaching, VIP coaching, group coaching, and other specialized services, are governed by an individual agreement. Please refer to your agreement for the specific terms of your program. If your individual agreement differs from these general Terms, your individual agreement governs that particular service, except where applicable law requires otherwise.

1. Coaching Services

Coach Brandi provides coaching and educational services designed to support personal and professional growth in areas that may include personal development, relationships, career, business, leadership, stress management, communication, lifestyle, and other areas related to the program selected.

Services may be delivered through:

• Private 1:1 coaching.

• VIP or Premier coaching.

• Group coaching.

• Community coaching programs.

• Courses and digital programs.

• Workshops and events.

• Virtual or in-person experiences.

• Other services described in your specific offer or agreement.

The exact services, duration, access, support, and benefits included in your purchase are determined by your specific offer, checkout, invoice, and/or individual agreement.

Not every service includes every type of support.

2. Your Individual Program Agreement

Certain coaching services require a separate agreement containing terms specific to that program.

Your agreement may address matters such as:

• Program duration.

• Coaching sessions.

• Scheduling and rescheduling.

• Communication and support.

• Payments and payment plans.

• Pauses or extensions.

• Cancellation or early termination.

• Refunds.

• Included resources or services.

• Other program-specific requirements.

Please refer to your individual agreement for the specific terms governing your program.

These website Terms provide general conditions across Coach Brandi's services. Your individual agreement provides the details that apply specifically to your coaching engagement.

3. Your Participation & Results

Coaching is a collaborative process and requires active participation.

Coach Brandi may provide education, coaching questions, observations, exercises, recommendations, resources, perspectives, strategies, and opportunities for reflection.

You remain responsible for your own decisions, actions, participation, implementation, and results.

Individual experiences vary. No particular personal, relationship, career, business, financial, health, or other result is guaranteed.

Testimonials and examples shared by Coach Brandi represent individual experiences and should not be interpreted as promises that another client will achieve the same results.

4. Coaching Is Not Medical or Mental Health Treatment

Coaching and educational services are not substitutes for psychotherapy, psychiatric care, medical treatment, diagnosis, emergency services, or crisis intervention.

Coach Brandi does not diagnose or treat mental-health disorders or medical conditions through coaching.

Information related to holistic health, stress management, brain health, nutrition, wellness, lifestyle, or similar subjects is provided for educational and coaching purposes and is not individualized medical advice.

Please consult an appropriately licensed professional when your needs fall outside the scope of coaching.

If you are experiencing a medical or mental-health emergency, are in immediate danger, or believe you may harm yourself or another person, do not rely on a coaching session, course, Community, email, text message, or Coach Brandi for emergency assistance. Contact appropriate emergency or crisis services in your location.

5. Private, VIP & Group Coaching

Private, VIP, Premier, and group coaching programs vary in duration, frequency, level of access, and included services.

Your specific offer and/or signed agreement determines what is included in your program.

Enrollment in one program does not automatically include services offered through another program.

Group coaching involves interaction with other participants. Individual coaching time during every group session is not guaranteed, and participants may also benefit from observing the coaching and experiences of others.

For scheduling, communication access, program duration, payment obligations, cancellations, pauses, extensions, missed sessions, and other program-specific policies, please refer to your individual agreement.

6. Community Coaching Programs

Community programs may include live coaching, workshops, Q&A coaching, courses, resources, replays, community discussions, and other benefits described in the applicable offer.

Each Community may operate differently.

The schedule, curriculum, access period, billing frequency, benefits, and other conditions of your Community are determined by the applicable offer and program information.

Membership in a Community does not automatically include private 1:1 coaching or unlimited individual access to Coach Brandi unless specifically stated.

7. Discover the Power Within Community

The Discover the Power Within Community (“DPW Community”) is an ongoing personal-development coaching membership.

Depending on the applicable membership, benefits may include:

• The Trust Factor Program.

• Discover the Power Within curriculum.

• The Discover the Power Within Workshop.

• Centering Saturdays — Q&A Coaching.

• Questions for Coach Brandi.

• Grateful Moments.

• Community participation.

• Resources and available replays.

For applicable new memberships, The Trust Factor Program is available upon enrollment.

The Discover the Power Within curriculum begins unlocking approximately 28 days after enrollment and is progressively released to support learning, reflection, and integration.

The release schedule does not guarantee completion within a particular billing period.

Current live coaching generally includes:

The Discover the Power Within Workshop
Tuesdays · 5:00–6:30 PM HST

Centering Saturdays — Q&A Coaching
Saturdays · 8:00–9:30 AM HST

Schedules may occasionally change due to holidays, illness, emergencies, events, technology issues, or other reasonable circumstances. When reasonably possible, members will be notified of changes.

8. Lifetime Purchases & Legacy Course Owners

If you previously purchased a course or program that expressly included lifetime access, joining a Community membership does not remove that existing access.

For eligible DPW Community Legacy Course Owners, previously purchased lifetime access to The Trust Factor and/or Discover the Power Within remains yours even if your DPW Community membership later ends.

If your membership provides access to a course you did not previously purchase with lifetime access, that additional access is a membership benefit and may end when your membership ends.

Membership access does not convert a course into a lifetime purchase unless lifetime access was expressly included in your purchase.

9. Payments & Payment Plans

You agree to pay the fees associated with the service you purchase according to the payment terms presented at checkout, on your invoice, or in your individual agreement.

You authorize the applicable payment processor to charge the payment method provided according to the payment schedule you select.

You are responsible for maintaining accurate billing information.

A payment plan for a fixed-term coaching program may represent installment payments toward the total program investment. It is not necessarily a cancel-anytime monthly membership.

Clients participating in agreement-based coaching programs should refer to their individual agreement for payment and early-termination obligations.

10. Recurring Memberships & Automatic Renewal

Certain memberships and Community programs are recurring subscriptions.

The price and billing interval applicable to your membership are displayed at checkout.

UNLESS OTHERWISE STATED AT CHECKOUT, RECURRING MEMBERSHIPS AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNTIL CANCELED. THE PAYMENT METHOD ON FILE WILL BE CHARGED FOR THE NEXT BILLING PERIOD.

For example, a membership selected as:

• Monthly renews monthly.

• Every 3 months renews every 3 months.

• Every 6 months renews every 6 months.

By purchasing a recurring membership, you authorize these recurring charges until cancellation.

11. Canceling a Recurring Membership

Eligible recurring memberships managed through Kajabi may be canceled by:

Logging in → Clicking your profile picture → Settings → Billing → Following the cancellation instructions for the applicable subscription.

Cancellation should be completed before the next renewal is processed if you do not want another renewal charge.

Cancellation prevents future renewals. It does not automatically refund a payment already processed.

Unless otherwise stated or required by law, membership access ordinarily continues through the applicable paid period following a voluntary cancellation. Membership-based access and benefits end when the applicable membership access ends.

If you later choose to return, you may be required to enroll again at the pricing and eligibility requirements available at that time.

This self-service membership cancellation policy does not necessarily apply to private coaching, VIP programs, fixed-term programs, payment plans, or services governed by a separate agreement. Please refer to your individual agreement for those terms.

12. Special & Preferred Membership Rates

Certain eligible clients or members may receive Preferred, Founding, Legacy, referral, promotional, or other special pricing.

Unless otherwise stated in the applicable offer, a special recurring membership rate may remain available while that subscription remains continuously active.

If the membership ends and the individual later re-enrolls, the previous rate is not guaranteed.

Special rates are not transferable.

13. Failed Payments

If a scheduled payment fails, the payment processor may attempt collection again according to its procedures.

Access to a membership, course, Community, coaching service, or other paid service may be suspended or terminated when required payments remain unsuccessful or past due.

A failed payment does not create a right to continued access without payment.

Clients with fixed-term coaching agreements or payment plans remain subject to the payment obligations contained in their individual agreements.

Previously purchased eligible lifetime products are not converted into temporary membership products because of a separate failed membership payment.

14. Refunds

Unless a specific offer, checkout disclosure, individual agreement, written guarantee, or applicable law expressly provides otherwise, payments are non-refundable once processed.

Canceling a recurring membership prevents future renewal charges but does not automatically refund a payment already processed.

Choosing not to participate, missing a live session, failing to use available materials, changing your mind, or not completing a program does not by itself create a right to a refund.

Private coaching, VIP coaching, group programs, fixed-term programs, events, and other agreement-based services may have additional refund, cancellation, pause, or termination provisions.

Please refer to your individual agreement for the terms specific to your program.

Nothing in these Terms limits consumer rights that cannot legally be waived.

15. Scheduling, Rescheduling & Missed Sessions

Scheduling and attendance policies vary depending on the service purchased.

Private coaching and certain other programs may have specific requirements relating to:

• Scheduling.

• Rescheduling.

• Late cancellations.

• Missed sessions.

• Program pauses.

• Extensions.

• Unused sessions.

These policies are governed by your applicable booking policy and/or individual agreement.

A missed or unused session does not automatically create a refund, credit, replacement session, or program extension.

16. Replays & Recordings

Certain live coaching sessions, workshops, classes, or events may be recorded and made available as replays.

Replay availability is not guaranteed for every session and may not be permanent.

A recording may be edited, withheld, removed, or not published when appropriate because of privacy, sensitive discussions, technical issues, or other reasonable circumstances.

Participants may not download, screen-record, reproduce, redistribute, publish, sell, or share protected recordings or coaching materials without written permission.

When a session will be recorded, reasonable notice will be provided.

Participation after such notice acknowledges that the session may be recorded for applicable program purposes.

Participation in a recorded session does not automatically give Coach Brandi permission to use your identifiable personal story, testimonial, image, voice, or coaching experience publicly for advertising or promotional purposes. Separate permission may be requested when appropriate.

17. Privacy in Group & Community Programs

Group coaching and Communities involve interaction with other participants.

Please use appropriate judgment when deciding what personal information to share.

Participants agree not to:

• Record another participant without authorization.

• Distribute screenshots containing another participant's private information.

• Share another participant's personal story without permission.

• Publish another participant's coaching conversation or personal information.

• Use information shared in the coaching environment to harass, exploit, embarrass, or harm another person.

Although respectful behavior and privacy are expected, Coach Brandi cannot guarantee another participant's confidentiality.

18. Community Conduct

Participants are expected to communicate respectfully.

Harassment, threats, bullying, abusive conduct, discrimination, repeated disruption, unauthorized solicitation, spam, unauthorized promotion, sharing another participant's confidential information, or unauthorized distribution of program materials may result in content removal, suspension, or termination of access.

Serious behavior affecting the safety or well-being of Coach Brandi, staff, facilitators, or other participants may result in immediate removal.

Termination for serious misconduct or violation of program terms does not automatically create a right to a refund.

19. Intellectual Property

Courses, videos, recordings, exercises, worksheets, workbooks, frameworks, training materials, written content, graphics, presentations, Community resources, and other original materials provided by Coach Brandi are protected intellectual property to the extent permitted by law.

Unless expressly authorized in writing, materials are provided for the purchaser's personal use only.

You may not:

• Share paid materials or account access with another person.

• Reproduce or redistribute protected materials.

• Upload protected content elsewhere.

• Sell or sublicense program content.

• Record or screen-record protected sessions or videos.

• Republish Coach Brandi's exercises, frameworks, or materials as your own.

• Commercially use protected coaching or training materials without written authorization.

20. Account Access

Your login credentials are for your individual use unless your offer expressly provides otherwise.

You are responsible for protecting your account information.

Unauthorized account or paid-content sharing may result in suspension or termination of access.

21. Career, Business & Financial Information

Some coaching services may discuss careers, entrepreneurship, business, leadership, marketing, sales, money habits, pricing, professional decisions, or financial goals.

This information is provided for coaching and educational purposes.

Coach Brandi is not acting as your attorney, accountant, investment adviser, tax professional, or financial planner.

You remain responsible for your business, employment, contractual, legal, tax, investment, and financial decisions.

No income, revenue, employment, business-growth, or financial result is guaranteed.

22. Love & Relationship Coaching

Relationship coaching may address areas such as dating, communication, boundaries, trust, healing, connection, and relationship patterns.

Relationship coaching does not guarantee reconciliation, marriage, finding a partner, preventing separation or divorce, or changing another person's behavior.

Each participant remains responsible for their own decisions and actions.

Relationship coaching is not a substitute for psychotherapy, couples therapy, legal services, domestic-violence services, or other professional support when those services are appropriate.

Clients participating in private or couples coaching should refer to their individual agreement for additional program-specific terms.

23. Wellness & Lifestyle Information

Some services may discuss food, nutrition, meal preparation, grocery shopping, movement, stress management, sleep, brain health, or other lifestyle and wellness topics.

This information is educational and coaching-oriented and is not medical diagnosis, treatment, or individualized medical care.

Participants are responsible for considering their own health conditions, allergies, medications, physical limitations, dietary restrictions, and professional medical advice before making changes.

24. Events & In-Person Experiences

Certain programs may include in-person events, workshops, outdoor activities, wellness experiences, or other experiential services.

Participation is voluntary.

Participants are responsible for determining whether they can safely participate and for communicating relevant limitations when appropriate.

Additional event-specific terms, waivers, venue requirements, or safety instructions may apply.

Event details may reasonably change when necessary.

25. Third-Party Technology

Services may rely on third-party platforms for payments, video meetings, courses, Communities, scheduling, email, or other functions.

Temporary interruptions may occur because of third-party outages, internet disruptions, maintenance, or other circumstances outside Coach Brandi's reasonable control.

When reasonably necessary, another delivery method may be substituted.

26. Suspension or Termination

Coach Brandi may suspend or terminate access for reasons including:

• Material violation of these Terms or an individual agreement.

• Nonpayment.

• Fraud.

• Serious or repeated disruptive or abusive behavior.

• Unauthorized distribution of protected materials.

• Serious privacy or Community violations.

• Conduct that creates reasonable safety concerns.

Where appropriate, an effort may first be made to resolve the issue.

Termination for misconduct or breach does not automatically create a right to a refund or eliminate payment obligations contained in an applicable agreement.

27. Limitation of Liability

To the fullest extent permitted by applicable law, Coach Brandi and associated employees, contractors, facilitators, representatives, and business entities will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in or use of services.

To the fullest extent permitted by law, total liability arising from a particular purchased service will not exceed the amount paid for the service giving rise to the claim during the applicable period.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

28. Changes to Programs or Services

Reasonable changes may occasionally be made to schedules, resources, technology, delivery methods, facilitators, lesson organization, or program structure.

Changes may be necessary because of holidays, illness, emergencies, participant privacy, technology, scheduling needs, or other reasonable circumstances.

When appropriate, participants will be notified of material changes affecting their service.

Reasonable modifications that do not materially eliminate the service purchased do not automatically create a right to a refund.

29. Governing Law & Disputes

These Terms are governed by the laws of the State of Hawaiʻi, except where another jurisdiction's non-waivable consumer protections apply.

Before pursuing formal legal action, the parties agree to make a good-faith effort to resolve the dispute directly.

Where appropriate, the parties may mutually agree to mediation or another form of alternative dispute resolution.

Unless applicable law requires otherwise, court proceedings relating to these Terms or Coach Brandi's services shall be brought in an appropriate court in the State of Hawaiʻi.

30. Updates to These Terms

These Terms may be updated periodically to reflect changes in services, technology, business operations, or legal requirements.

The effective date will be displayed at the top of this page.

Material changes affecting an existing recurring subscription will be communicated as required by applicable law.

Updates to these Terms do not retroactively convert an eligible previous lifetime purchase into temporary membership access.

31. Prior Purchases & Agreements

These Terms do not automatically replace rights or obligations established in a previously signed agreement or expressly stated prior purchase terms.

If you purchased a service under a separate agreement, that agreement remains relevant to the specific purchase.

32. Contact

Questions regarding your program, billing, access, or these Terms may be directed through the contact information provided on the Coach Brandi Kiana-Jo website or within your client/member account.

For eligible recurring memberships managed through Kajabi:

Clients participating in private coaching, VIP coaching, fixed-term programs, payment plans, or other agreement-based services should refer to their individual agreement for applicable cancellation or termination terms.

Acknowledgment

By purchasing, enrolling in, accessing, or participating in a Coach Brandi Kiana-Jo service, you acknowledge that you have read and agree to these Terms & Conditions and any additional terms applicable to your specific purchase.

For recurring memberships, you acknowledge that your membership will automatically renew according to the billing interval selected at checkout until canceled, and you authorize recurring charges to the payment method provided.

If your coaching program includes an individual agreement, you acknowledge that the agreement contains additional terms specific to your program and should be referred to for those terms.
